Conditions for Becoming a Turkish Citizen by Marriage

Conditions for Becoming a Turkish Citizen by Marriage
First of all, being married to a citizen of the Republic of Turkey does not directly give the foreign national the right to become a Turkish citizen. Getting married does not even give a foreign national the right to reside in Turkey. These are completely separate processes and must be managed correctly. The conditions for gaining Turkish citizenship through marriage are regulated in Article 16 of the Citizenship Law (No. 5901). In accordance with the text of the relevant law, in order for a foreign national to become a Turkish citizen through his/her spouse who is a citizen of the Republic of Turkey, he/she must meet the following conditions:

A foreign national applying for Turkish citizenship must have been married to a Turkish citizen for at least three years. It is also necessary that this marriage is already ongoing.
Spouses must live in family unity.
The foreigner must not engage in activities that violate the unity of marriage.
The foreign person must not pose a threat to public security.
Foreign nationals can apply for the relevant citizenship to the civil registration offices in their settlements, if they meet the above conditions. If a situation such as the death of the Turkish citizen spouse occurs after the application, the condition in the second place in the list above, that is, the condition that the spouses are in a family unit, is not required. A foreign national can become a Turkish citizen if he/she meets other conditions. However, foreign nationals who have acquired Turkish citizenship through marriage continue to retain their citizenship of the Republic of Turkey in the event of a decision to annul the marriage, if they are in good faith in their marriage.

Procedures and Principles of Turkish Citizenship by Marriage
In the regulation on the implementation of the citizenship law no. 5901, the procedures and principles regarding the processing of the application by the application authorities and the acquisition of citizenship are mentioned. People who meet the conditions listed in Article 16 of this law can gain the right to apply for Turkish citizenship through marriage. An examination is carried out by the application authorities about the foreign national who applied. After completing this review, if the following results are seen, the person's application is not accepted and the necessary information is given to him/her:

If it is understood that the person has not been married to a citizen of the Republic of Turkey for at least three years, the application will not be accepted.
If it is understood that the marriage regarding the application ended due to a reason such as divorce or the death of the spouse who is a citizen of the Republic of Turkey before the citizenship application date, the application will not be accepted.
If it is understood that the applicant foreigner is in judicial process or convicted or detained for any crime, the application will not be accepted.
The applications of those who are understood to be unable to submit the Turkish citizenship application documents required in accordance with Article 26 of the regulation, which we have detailed above, are also not accepted.
Important note: If the spouse of the foreigner who wants to acquire Turkish citizenship is someone who acquired Turkish citizenship later, the date of this person's acquisition of Turkish citizenship is taken as basis in calculating the time they spent in their marriage.

Domestic Application Conditions
There are some procedures and principles in the procedures to be carried out for people who will apply for Turkish citizenship and whose place of residence is Turkey. An application file is prepared for the foreign national who is understood to meet the necessary conditions for application, and the police department is asked to conduct an investigation about the foreign person. The police department is investigating the following issues in this investigation:

It is checked whether the foreign national applying for Turkish citizenship and his Turkish citizen spouse live in a family unit.
It is checked whether the applicant has committed any actions that are incompatible with the marriage union. For example, engaging in prostitution and mediating prostitution, etc. It is examined whether such behaviors exist. After the review, opinions regarding this are stated in the file.
It is checked whether there is any issue that would prevent the applicant from gaining Turkish citizenship in terms of the country's security and public order.
These above-mentioned situations are investigated and the resulting opinion, positive or negative, is written clearly and in detail on the investigation form. Minutes of the investigation are also added to this investigation form. The file of the foreign applicant, whose investigation is completed by the police department officials, is returned to the provincial directorate. After this, the file is sent to the commission unit by the provincial directorate for other necessary examinations and research. The person's file is sent to the Ministry by the provincial directorate for the final decision.

Application Conditions from Abroad
A file consisting of the documents we have mentioned in detail above is prepared on behalf of the foreign national who wants to become a Turkish citizen and meets all the necessary conditions for the application. The required documents for applications made from abroad may differ compared to those for applications made from Turkey. Since this situation varies from country to country where people reside, it is not possible to present a list of required documents valid for all countries on our page, but Mehran Translation Consultancy experts will help you in the best way to provide you with a detailed list of documents.

After the application, the foreign national and his or her spouse are interviewed, both separately and together, by the vice consul who is responsible for consular procedures or a superior official to determine whether their marriage is a real marriage or a sham marriage made for the acquisition of Turkish citizenship. The opinion formed as a result of this interview, whether positive or negative, is written in detail and clearly on the interview form of the foreigner who wants to acquire Turkish citizenship through marriage. If the laws of the state where the foreign person or persons reside allow, a criminal record is also requested and it is investigated whether the marriage records of the foreigner and his Turkish citizen spouse are in the official authorities of that state. The resulting information and documents are added to the person's file and sent to the Ministry for a final decision.

How long does it take to apply for Turkish Citizenship?
The rapid progress of the procedures in applications for Turkish citizenship depends on the complete and accurate preparation of the file. All information and documents provided in citizenship applications must be complete and not false. Since the deficiencies in this information and documents will cause the administration to attempt to provide them during the continuation of the application process, this situation causes the application process to proceed slower than normal.
